Terms & Conditions
Last updated: 14 September 2026.
1. About these terms
These are the terms on which Hushly LLC ("we", "us", "our") sells to you through hushlykids.com (the "Site"). They cover every order placed on the Site by a consumer, meaning someone buying wholly or mainly for purposes outside their trade, business, craft or profession.
By placing an order you accept these terms, so please read them first. The version that applies to your order is the one on this page when you confirm it. If we choose not to rely on a term at some point, we can still rely on it later.
2. Who we are
The Site and the Hushly Kids store are operated by Hushly LLC, a single member limited liability company formed in the State of New Mexico, United States, on 10 June 2026, New Mexico Secretary of State entity ID 0008107153.
Registered office: 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, United States.
Hushly LLC is a United States company. It is not incorporated in the United Kingdom and therefore has no Companies House registration and no UK company number. Selling to consumers in the United Kingdom, it is bound by United Kingdom consumer law for those sales.
The best way to reach us about anything to do with an order is by email at hello@hushlykids.com. You can also use our contact page.
We sell under the name Hushly Kids. Our store runs on Shopify, which hosts the Site and handles the checkout and payments. More about us is on our Company Information page, which is part of these terms, and how we use your data is explained in our Privacy Policy.
3. Products and descriptions
The products offered are those shown on the Site on the day you look at it, while stocks last. Each product carries a description of its essential characteristics: what it is, what it is made of, its dimensions, what it is for and how to look after it. Please read it before you order.
Photographs and illustrations are there to show the product as faithfully as possible. Small differences of appearance, shade or rendering can occur, in particular because of the screen you are reading on. If you are unsure about a characteristic, ask us before you order.
4. Prices
Prices are shown on the Site in pounds sterling and include UK VAT at the standard rate of 20%.
You pay the price shown when you confirm your order. We can change our prices at any time, but a change never affects an order you have already confirmed.
Delivery is free on every order to the areas listed on our Shipping and Returns page: no delivery charge is added to the price you see.
The checkout page shows the full amount you will pay before you confirm.
5. Placing an order
Add what you want to your basket and go to the checkout, where you give us your delivery and payment details. You can check the order and the total, and fix any mistake, before you confirm.
A contract is made between us when you confirm your order and your payment goes through. We then email you a confirmation of your order.
We may cancel or refuse an order that is clearly abnormal, made in bad faith, or placed by someone with whom we have an unresolved dispute about the payment of an earlier order.
We keep a secure record of your order, your payment and our messages to you, in our systems and those of the providers we use, and we can send you a copy of your order and invoice if you ask at hello@hushlykids.com.
6. Payment
You pay the full amount online when you confirm your order, through the secure Shopify checkout, using one of the payment methods offered on the checkout page at that time.
By paying, you confirm you are entitled to use that payment method. Your card details are encrypted and handled by the payment provider, not by us: we never see your full card number and do not keep it. If your bank refuses the payment, or if a payment looks fraudulent, we may hold or cancel the order.
Any fee, commission or exchange rate difference charged by your own bank or card issuer, in particular where your account is held in a currency other than pounds sterling, is not received by us, is not a sum paid to us, and cannot be refunded by us.
7. Availability
Our offers are valid for as long as they are shown on the Site, while stocks last. If a product turns out to be unavailable after you have ordered it, we will tell you by email as soon as we can. Your order for that product is then cancelled and we refund everything you paid for it, at the latest within 14 days of telling you, with nothing deducted.
8. Delivery
We deliver to the address you give us at checkout, free of charge, within the areas listed on our Shipping and Returns page. That page also gives our usual delivery times and explains tracking. Right now, allow up to 12 days. Times are estimates: a carrier delay or an event outside our control can make a parcel later.
If your parcel is unusually late, write to us at hello@hushlykids.com and we will look into it. When the parcel arrives, please check its condition and tell us straight away about any visible problem. Goods are your responsibility from the time they are delivered to the address you gave us.
Refused or unclaimed parcels. It is up to you to receive your parcel, or to collect it within the time given by the carrier when it is left at a collection point. If a parcel comes back to us because it was refused, not collected in time or sent to an address that was wrong, the carrier's return charge is yours, and so is the cost of sending it out again. If you would rather be refunded, tell us in writing: the refund goes out once the parcel is back with us, with the return charge deducted. Refusing a parcel is not by itself a notice of cancellation.
9. Your right to cancel
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you have 14 days to cancel your order, without giving any reason.
That period runs from the day you, or someone you name other than the carrier, take physical possession of the goods. Where an order is made up of several products delivered separately, it runs from the day you receive the last one.
To cancel, send us a clear statement of your decision: an email to hello@hushlykids.com, a message through our contact page, or a letter to Hushly LLC, 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, United States. The model cancellation form is on our Right of Withdrawal page; using it is optional. Your statement is in time if you send it before the 14 days end, and it counts from the date you send it.
You must send the goods back without undue delay and at the latest 14 days after telling us you are cancelling. You bear the direct cost of returning the goods.
We refund the price you paid and the standard delivery cost at the latest 14 days after we receive the goods back or you provide evidence that you have sent them, whichever comes first. We use the same means of payment as for your order, unless you expressly agree otherwise, and we do not charge you any fee for the refund.
Diminished value. Opening the box and looking the pillow over, as you would in a shop, never leads to a deduction. Sleeping on it is different: a pillow a child has slept on, even once, cannot be passed to another family, so that use goes beyond what is needed to see what the pillow is and how it works. You are liable for the loss of value this causes, and it can be large. The deduction is assessed case by case, on the actual state of the goods we receive, using this indicative scale:
- Never used, complete, clean and able to go back on sale: nothing is deducted and the full price is refunded.
- Used, even returned clean and complete: 75% of the price paid for the item is deducted, so you are refunded 25%.
- Stained, smelling, washed, damaged or incomplete: the deduction can reach the full price of the item, as it can be neither checked nor put back into circulation.
The state of the goods is recorded and documented when the return parcel is opened, we explain the amount and the reason to you before we apply any deduction, and a deduction can never exceed the price you paid for the item. For a pillow that is unused or used, it matches the scale of the 30 night trial in article 10.
You can make your request through our Refund or Cancellation page, which helps us identify your order. Using that page is a convenience, not a condition: you can always cancel by a plain email to hello@hushlykids.com, recorded at the date you send it.
10. Commercial guarantee: the 30 night trial
On top of your right to cancel under article 9, we give you our own promise, the "30 night trial": thirty (30) nights, counted from the day the parcel is delivered, to try the pillow in your child's bed. It is a commercial guarantee we choose to offer, on the conditions below, and it sits alongside your right to cancel and your legal rights under article 11 without replacing or reducing either.
What the trial gives you. Within the 30 nights, we offer:
- Personal help getting the product right: choosing the size, positioning it in the bed, and the time a child needs to adjust.
- A free size exchange. If the size chosen does not suit your child and the product has not been used, we organise the exchange and pay its cost.
- A refund based on the state of the product. A pillow a child has slept on can never go to another family, for hygiene reasons. So we refund the full price of the product if it has never been used and can go back on sale; twenty five per cent (25%) of the price paid for the product if it has been used, even returned clean and complete; and nothing if it is stained, smelling, washed, damaged or incomplete.
- Sometimes another option, such as store credit, a replacement or a goodwill gesture. You can say yes or no; if you say yes, that closes your trial request.
Conditions. Personal help and the free size exchange are available at any time within the 30 nights. A product that has never been used can also be sent back for a full refund at any time within the 30 nights: it has to come back to us so that it can go back on sale, and the return postage is yours. Each of these starts with a request through our Refund or Cancellation page. A refund for a product that has been used is subject to all of the following conditions:
- At least 10 nights of use. Children take a few nights to settle on a new pillow, so this refund is open once your child has used it for ten (10) nights. If something is wrong before then, tell us anyway: we help straight away and record your request at its date.
- A request within 30 nights. You ask through our Refund or Cancellation page within thirty (30) nights of delivery, and tell us about your child's nights.
- A short video. We ask for a short video of the product, filmed in one take and following the instructions given when you make your request, so that we can establish its actual state. It very often lets us refund you without the product being sent back, in which case you keep it. Without sufficient evidence, the guarantee requires the product to be returned, and the state that counts is the one recorded when it reaches us.
Returns under the trial. Whenever a product is sent back under the trial, whether it has been used or not, the return costs are yours, except for a size exchange. The product must come back clean, complete, protected for the journey, and with a note giving your name and order number. Your refund goes out within 14 days of the product reaching us, or of your proof of postage reaching us if that comes first, on the card or account you paid with.
Step by step instructions are on our 30 Night Trial and Shipping and Returns pages. If a condition of the trial is not met, you still keep your right to cancel under article 9 and your legal rights under article 11 in full.
11. Your legal rights
Whatever happens with the commercial guarantee, you keep the legal rights attached to the sale. Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described. These rights apply independently of any commercial guarantee we give.
If goods are faulty or not as described, you can reject them within 30 days of delivery for a full refund. You can also ask for a repair or a replacement, and if that is not possible or does not fix the problem, you are entitled to a price reduction or to reject the goods. A fault that shows up within 6 months of delivery is presumed to have been there on delivery, unless we prove otherwise.
Where goods are faulty or not as described, returning them and refunding or exchanging them is entirely at our cost: you do not pay the postage and you do not pay a restocking charge. On top of these rights, we guarantee the pillow for 2 years against loss of height in normal use.
To use these rights, write to hello@hushlykids.com with your order number and, if you can, a photograph of the problem.
12. Customer service and complaints
Questions, problems or complaints: email hello@hushlykids.com or use our contact page. We reply within 48 working hours and try to sort things out with you directly.
13. Your personal data
We use the details you give us at checkout to fulfil, deliver and invoice your order and to help you afterwards, in line with UK data protection law. You can ask to see, correct or delete your data. Our Privacy Policy explains what we keep, for how long and how to use these rights, and our Cookie Policy covers cookies.
14. Intellectual property
The Hushly Kids name, the logos, the text, the photographs, the illustrations, the design of the pages and the structure of the Site are protected by intellectual property law and belong to us or to partners who have granted us the rights to use them. Reproducing, representing, adapting, modifying, distributing or exploiting any of it, in whole or in part, by any means, without our prior written permission, is not allowed. Placing an order gives you no intellectual property right over any part of the Site.
15. Our liability
We are responsible for the goods we sell under the Consumer Rights Act 2015, and we provide any related service with reasonable care and skill. We are not responsible for internet problems outside our control, such as an outage, a hacking attempt or a virus.
We are not liable for failing to perform the contract where the cause is an event outside our control within the meaning of article 16, something you did, or the act of a third party unconnected with the contract. We are not liable for damage caused by using a product in a way it was not intended for, or contrary to the care instructions given with it, nor for losses that were not foreseeable when the contract was made.
Nothing in these terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or under the Consumer Rights Act 2015.
16. Events outside our control
We are not liable for failing to perform, or for performing late, where the cause is an event outside our reasonable control that could not have been foreseen when the contract was made and whose effects could not be avoided by appropriate measures. We will tell you as soon as we can. Our obligations are suspended for as long as the event lasts. If it is permanent, or lasts an unreasonable time, the contract ends and we refund anything you paid for goods not delivered.
17. Resolving disputes
If there is a dispute about an order, please contact us first at hello@hushlykids.com so that we can look for an amicable solution together.
We are not a member of an alternative dispute resolution scheme, and we do not name one here. Consumer mediation in the United Kingdom is voluntary for a trader outside a regulated sector, and pointing you to a scheme that could not take your case would waste your time. Using any amicable route is always optional and never stops you from going to court, as set out in article 18.
18. Governing law and jurisdiction
These terms, and the contracts of sale made with consumers under them, are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the United Kingdom, you may bring proceedings in your local courts.
Wherever you live in the United Kingdom, you keep the protection of the mandatory consumer law of the place where you are habitually resident. Nothing in these terms takes that protection away from you.
19. Changes to these terms
We update these terms from time to time, for example when the law or our offer changes. Your order stays governed by the version you accepted when you placed it; a later order is governed by the version in force at that time. The date at the top shows when this page last changed, so please check it before each order.
